Living Will or Medical Power of Attorney

A Living Will or Medical Power of Attorney is a document, typically signed in advance while in good health, that specifies the decisions a person wishes to be taken about his medical treatment in the event of becoming incapable of making or communicating them (Microsoft Encarta Dictionary).

Although a Living Will has nothing to do with property dispositions, it is an equally important planning tool because of its value in conserving the estate of a person who suffers serious illness and preventing the unnecessary dissipation of wealth due to prolonged serious illness.

A Living Will typically includes the names of a trusted family physician and a person who is given the special power of attorney to make decisions based on the provisions of the document.
